Safety notice. Dock Watch is an informational tool that publishes estimated lake-level projections and related lake information. It is not a safety, navigation, flood-warning, or emergency service, and it is not monitored in real time. Projections are model estimates and can be wrong. Never rely on Dock Watch for any decision affecting life, safety, or property. For flood, dam-release, closure, and weather information, rely on official sources — the Lower Colorado River Authority (LCRA), the National Weather Service, and your local emergency authorities.
These Terms of Service (the “Terms”) form a binding agreement between you and the operator of Dock Watch (“Dock Watch,” “we,” “us,” or “our”). By creating an account, starting a free trial, subscribing, or otherwise accessing or using the Dock Watch website and dashboard (the “Service”), you agree to these Terms and to our handling of data as described here. If you do not agree, do not use the Service.
The Service aggregates publicly available gauge, weather, and reservoir data and applies a statistical model to produce estimated projections of Lake Travis levels, along with related context such as boat-ramp status, closures, water temperature, and general lake information. All output is provided for general planning and informational purposes only.
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, RELIABLE, TIMELY, UNINTERRUPTED, OR ERROR-FREE.
You understand that boating, swimming, dock operation, and being on or near the water carry inherent risks, and that lake levels and releases can change suddenly. You assume all risk arising from your use of the Service and from any decision you make in reliance on it. You are solely responsible for verifying conditions through official sources before acting.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DOCK WATCH OR ITS OPERATOR, OWNERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, PROPERTY, DATA, OR GOODWILL, OR FOR ANY PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY PROJECTION OR INFORMATION IT PROVIDES, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; in that case our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless Dock Watch and its operator, owners, officers, and suppliers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of or reliance on the Service or any projection or information it provides; (b) your violation of these Terms; or (c) your violation of any law or the rights of any third party. This obligation survives termination of your account and these Terms.
You are responsible for your account and for keeping your credentials secure. You agree not to misuse the Service, including by scraping, reselling, or redistributing the paid dashboard or its data, attempting to bypass access controls, or interfering with the Service’s operation. Access is licensed to you personally and is non-transferable.
The Service relies on data and infrastructure from third parties (including government gauges and weather feeds, and our authentication and payment providers). We do not control and are not responsible for the accuracy, availability, or practices of those third parties.
To provide the Service we process the account information you give us (such as your email) and, if you set alerts, the email and thresholds you submit. Payment and identity verification are handled by our payment and authentication providers under their own terms. We do not sell your personal information. Our Privacy Policy explains what we collect, how we use it, who we share it with, and how to request access to or deletion of your account data.
We may modify or discontinue the Service, and may update these Terms, at any time. Material changes take effect when posted here; your continued use after changes are posted constitutes acceptance.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The exclusive venue for any dispute that is not subject to individual arbitration or small-claims resolution will be the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction. You and Dock Watch agree that any dispute will be resolved on an individual basis and waive any right to participate in a class or representative action, to the extent permitted by law.
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be enforced to the maximum extent permitted. These Terms are the entire agreement between you and us regarding the Service.
